General Terms and Conditions

Article 1. Definitions

Provider: NLTAAL Dutch Language Training, located in Amstelveen, hereinafter referred to as “NLTAAL Dutch Language Training.”

Client: the natural person or legal entity that enters into an agreement with NLTAAL Dutch Language Training, regardless of whether it acts as a private individual or as a client (company).

Participant: the person who actually participates in a training session, course, or class.

Service: any form of language instruction offered by NLTAAL Dutch Language Training, including online classes, in-person classes, private lessons, and e-learning (with or without a workbook).

License: the personal and non-transferable right of access to digital course materials or an e-learning environment granted by NLTAAL Dutch Language Training for a specific period.

Distance contract: a contract concluded via a website, email, or a similar system for distance selling.

Article 2. Applicability

2.1 These terms and conditions apply to every quote, booking, and agreement between NLTAAL Dutch Language Training and the customer, regardless of whether the service is purchased online or otherwise arranged.

2.2 Any deviating agreements are valid only if NLTAAL Dutch Language Training has confirmed them in writing.

2.3 A business client’s own terms and conditions do not apply unless NLTAAL Nederlandse taaltrainingen has expressly accepted them in writing.

Article 3. Offer, Booking, and Formation of the Contract

3.1 Services can be booked through the website, by email, or—for business clients—via a quote.

3.2 The agreement is concluded as soon as NLTAAL Dutch Language Training confirms the booking in writing or by email, or as soon as the customer completes and pays for the order online.

3.3 NLTAAL Dutch Language Training may refuse a booking without providing a reason.

3.4 If there are insufficient registrations, NLTAAL Dutch Language Training may cancel a classroom course or combine it with another group. The customer will be notified in a timely manner and, in the event of cancellation, will receive a full refund or an appropriate alternative.

Article 4. Prices and Payment

4.1 All prices listed are in euros and, unless otherwise stated, include VAT.

4.2 Payment is due at the time of ordering via the website, or, for business clients, within 14 days of the invoice date.

4.3 Access to online classes, private lessons, in-person training, or e-learning will not be granted until payment has been received in full.

4.4 In the event of late payment, NLTAAL Dutch Language Training may suspend its services, and the customer will be liable for statutory interest and reasonable collection costs.

4.5 In the case of an agreement with a term of more than one year, NLTAAL Dutch Language Training may adjust its prices annually, provided that at least one month’s notice is given. The client may terminate the agreement in the event of a price increase, subject to a one-month notice period.

Article 5. Right of Withdrawal (for individual customers only)

5.1 This section applies exclusively to customers who, as private individuals (consumers), purchase a service online or remotely. Business customers do not have a right of withdrawal.

5.2 The individual customer has the right to terminate (cancel) the agreement within 14 days of its conclusion without providing a reason, unless otherwise specified below.

5.3 Direct access to e-learning or digital materials (license). If, when placing an order, the customer expressly chooses to receive immediate access to the e-learning environment or the digital course materials, and thereby expressly declares that they waive their right of withdrawal as soon as access is granted, the right of withdrawal expires at the moment the license is activated. Without this explicit consent, the right of withdrawal under Section 5.2 remains in full force.

5.4 For in-person or online classes that have already begun before the cancellation period expires, the following applies: if the customer has expressly requested to begin immediately and has acknowledged that they will thereby lose their right of withdrawal once the service has been fully performed, the customer shall pay, upon withdrawal, an amount proportional to what has already been provided.

5.5 To exercise the right of withdrawal, the customer must send an unambiguous statement (for example, by email) to NLTAAL Dutch Language Training. If the cancellation is made in a timely manner, NLTAAL Nederlandse taaltrainingen will refund the amount already paid within 14 days, less any amount owed pursuant to Section 5.4.

Article 6. Cancellation and Rescheduling by the Customer (After the Expiration of the Cancellation Period)

6.1 Cancellations or rescheduling must be made in writing (email is sufficient).

Up to 4 weeks before the start date: 25% of the course fee is due.

Within 4 weeks of the start date: 100% of the course fee is due.

6.2 A participant who is unable to attend an in-person class may make up the missed class once at no charge. Upon request and with proof of an urgent medical reason, a participant may make up the missed class at no charge; in other cases, a missed class may be rescheduled for an administrative fee.

6.3 Failure to show up without giving timely notice (no-show) does not entitle you to a refund or a make-up class.

6.4 There is no separate cancellation policy for learning licenses: once the license has been activated, Section 5.3 applies and no refunds will be issued.

Article 7. Provision of the Service

7.1 NLTAAL Dutch Language Training may change the time, location, format (online/in-person), or instructor, and will notify the customer of such changes in a timely manner.

7.2 A learning license is valid from the activation date for the agreed-upon period. Renewal upon expiration is possible for an additional fee.

7.3 NLTAAL Dutch Language Training strives to employ qualified instructors and reserves the right to substitute a previously announced instructor.

Article 8. Intellectual Property and Use of Materials

8.1 All rights to course materials, curricula, e-learning content, and licenses are held by NLTAAL Dutch Language Training.

8.2 The material is intended solely for the participant’s personal use. Reproduction, sharing, resale, or public disclosure without the prior written consent of NLTAAL Nederlandse taaltrainingen is not permitted.

8.3 A license is personal and non-transferable to another user.

Article 9. Liability

9.1 NLTAAL Dutch Language Training is liable only for direct damages that are the direct result of an attributable breach. Liability for indirect or consequential damages is excluded.

9.2 NLTAAL Nederlandse taaltrainingen’s liability for each incident is limited to the amount the customer paid for the service in question, up to a maximum of the amount paid out by the liability insurance policy in the relevant case.

9.3 A claim regarding liability must be submitted in writing to NLTAAL Dutch Language Training within 2 weeks of discovery.

9.4 Nothing in this section limits liability for willful misconduct, gross negligence, or in cases where such limitation is not permitted under mandatory consumer law.

Article 10. Confidentiality and Privacy

10.1 The parties shall treat any confidential information they receive from each other as confidential, even after the agreement has ended.

10.2 NLTAAL Dutch Language Training processes personal data in accordance with its current privacy statement and the GDPR.

Article 11. Governing Law and Disputes

11.1 These terms and conditions and all agreements with NLTAAL Dutch Language Training are governed by Dutch law.

11.2 Disputes shall be brought before the competent court in the judicial district where NLTAAL Nederlandse taaltrainingen is located, unless mandatory law provides otherwise.
